Oversight Response Options

As a general rule, TET does not have the authority to instruct DSIS, DDIS, CFCS or the PNR Unit to take specific measures regarding the processing of information.

However, TET may issue statements to the authorities, including expressing its opinion on whether DSIS, DDIS, CFCS or the PNR Unit complies with applicable legislation.

If DSIS, DDIS, CFCS or the PNR Unit has comments on the outcome of an review, these must be submitted to TET within a specified deadline.

If the authorities decide not to follow a recommendation from TET or fail to meet their obligation to provide information, the matter must be referred to the Minister of Justice or the Minister of Defence for a decision, as illustrated above.

TET must also inform the Minister of Justice and the Minister of Defence of any matters which, in TET’s opinion, the ministers ought to be made aware of.

At the conclusion of its reviews, TET uses the following scale to issue comments:

TET issues annual reports on its activities to both the Minister of Justice and the Minister of Defence. These reports are published and can be accessed in TET’s Reports.
